(Virtual Interline) VI Guarantee.

If you buy Virtual Interline air tickets in addition to the provision of formation / sale of air tickets the VI Provider usually offers an additional service defined by it the Guarantee (hereinafter the VI Guarantee).

The essence of the VI Guarantee is the effort to cover in whole or in part certain situations occurred within or in connection with flights that you book / perform, such as cancellation / delay of a flight from a group of flights on Virtual Interline.

In order for you to better understand the essence and the scope of the VI Guarantee we present further an Excerpt from the VI Guarantee, followed by an explanation of the content, scope, use of the VI Guarantee, limitations, exceptions, application procedure for the VI Guarantee, etc.

Excerpt from the VI Guarantee.

”1. The Guarantee. In particular, the scope of the Guarantee is split into two categories, based on severity:

Scenario A (More than 48 hours before departure)

More than 48 hours before departure – the Guarantee stipulated in this article applies only to a change or cancellation of Flight(s) announced more than 48 hours prior to departure of the first concerned Flight, which may negatively impact an ability to reach the Destination or an arrival at the Destination shall change by more than 24 hours from the original scheduled arrival, i.e. due to Flight change(s) or cancellation(s) Flight Connection(s) is missed or Flight(s) would be cancelled (hereinafter referred as “Scenario A”).

In this case, if You learn about a change or cancellation of Flight(s) under Scenario A You must inform Us of such a change or cancellation without undue delay either by e-mail. Should You fail to inform Us about such Flight change(s) or cancellation(s) without undue delay, You will not be entitled to the Guarantee. In case, We are informed first about the change or cancellation of Flight(s) according to Scenario A, We will contact You within a reasonable time after We learn about such Flight change(s) or cancellation(s).

After We have been informed about the Flight change(s) or cancellation(s) according to Scenario A, We will offer You one of the following solutions solely at Our discretion:

1. We will search for alternative transportation to the Destination. Should We find a reasonable alternative transportation (i.e. an alternative Flight(s) the amount of which is limited up to the amount paid by You for the original Flight(s)) We will offer You an alternative Flight(s) to the Destination entirely at Our expense. In case We are unable to buy the offered alternative Flight(s) for You online, You can buy the respective ticket(s) for the alternative transportation, as agreed upon by Us and You, and We will refund You the price of such ticket(s) under the conditions given in the Guarantee. Please note that any extra services or further upgrades to the agreed upon alternative ticket(s) will not be covered by Us.

2. We will offer You a refund of the price You paid for all the unused Flights under the conditions specified in the Guarantee. This solution is most likely to be offered in case we are unable to offer You reasonable alternative transportation.

You are obliged to reply to Us promptly after receiving Our information about the offered solution(s), but in all cases at the latest within 24 hours since Our first notice regarding the solution(s) is considered as having been delivered to You in accordance with the Guarantee, or within any shorter reasonable time before the time of the scheduled departure of the first following Flight. After the lapse of these 24 hours, or any shorter term for replies this offer is null and void, thus You will not be entitled to the Guarantee subsequently in this matter.

Scenario B (Less than 48 hours before departure)

Less than 48 hours before departure - The Guarantee stipulated in this Article applies only to a Flight Delay(s) or cancellation(s) of Flight(s) announced less than/equal to 48 hours prior to the departure and/or after departure of the first concerned Flight, which may negatively impact an ability to reach the Destination or an arrival at the Destination shall change by more than 24 hours from the original scheduled arrival, i.e. due to the Flight Delay(s) or cancellation(s) Flight(s) Connection(s) is missed or Your Flight(s) would be cancelled (hereinafter referred as “Scenario B”).

In this case, if You learn about a Flight Delay(s) or cancellation(s) of the Flight under Scenario B, You are obliged to inform Us of such a Flight Delay(s) or cancellation(s) without undue delay by telephone or email. Should You fail to inform Us about such a Flight Delay(s) or cancellation(s) without undue delay, You will not be entitled to the Guarantee. In case, We are informed first about the Flight Delay(s) or cancellation(s) of the Flight under Scenario B, We will contact You within a reasonable time after We learn about it.

1.) After We have been informed about the Flight Delay(s) or cancellation(s) of Flight(s) announced less than/equal to 48 hours prior to the departure the first concerned Flight under Scenario B, You may choose one of the following solutions at Your discretion:

1. We will search for alternative transportation to the Destination and should We find a reasonable alternative transportation (i.e. an alternative Flight(s) the amount of which is limited up to the amount paid by You for the original Flight(s) multiplied by 2 (two)) We will offer You an alternative Flight(s) to the Destination entirely at Our expense. In case We are unable to buy the offered alternative Flight(s) for You online, You can buy the respective ticket(s) for the alternative transportation, as agreed upon by Us and You, and We will refund You the price of such ticket(s) under the conditions of the Guarantee. In case We are unable to find a reasonable alternative Flight(s), we may agree with You on Our proportional contribution to the costs associated with the mutually agreed alternative transportation. This option will be determined and agreed on a case by case basis. Please note that any extra services or upgrades to the agreed upon alternative ticket(s) will not be covered by Us.

2. We will refund You the price You paid for all the unused Flights under the conditions specified in the Guarantee. You should choose this solution in case we are unable to offer You a reasonable alternative transportation.

2.) After We have been informed about the Flight Delay(s) or cancellation(s) of Flight(s) after departure of the first concerned Flight under Scenario B, You may choose one of the following solutions at Your discretion:

1. We will search for alternative transportation to the Destination and should We find an alternative transportation We will offer You an alternative Flight(s) to the Destination entirely at Our expense. In case We are unable to buy the offered alternative Flight(s) for You online, You can buy the respective ticket(s) for the alternative transportation, as agreed upon by Us and You, and We will refund You the price of such ticket(s) under the conditions of the Guarantee. Please note that any extra services or upgrades to the agreed upon alternative ticket(s) will not be covered by Us.

2. We will refund You the price You paid for all the unused Flights under the conditions specified in the Guarantee. You should choose this solution in case we are unable to offer You an alternative transportation.

You are obliged to reply to Us about Your choice promptly after receiving Our information about the offered solution, but in all cases at the latest within 24 hours since Our notice is considered as have been delivered to You in accordance with the Guarantee, or within any shorter reasonable time before the time of the scheduled departure of the first following Flight. After the lapse of these 24 hours or any shorter term for replies the offer expires and You are no longer entitled to the Guarantee in this matter.”

Notes on the content, scope, use of the Guarantee, limitations, exceptions, etc.:

These Terms and conditions display only an informative Excerpt from the VI Guarantee.

If you buy one or more air tickets as Virtual Interline, in particular provided by or through the VI Provider, then the VI Guarantee shall be displayed to you in full on the avia.md web page interface (in case you buy the air ticket / tickets online), or it shall be physically printed at your request (if you buy the air ticket / tickets personally in the Company office). Hence, buying VI type air ticket / tickets you confirm that you have read the VI Guarantee in full, with all its provisions and conditions.

Any reference to the VI Guarantee in These Terms and conditions shall be a reference to the VI Guarantee in full in the VI Provider’s original text in effect on the date of an eventual verification of its applicability.

Definitions and terms provided in the Excerpt from the VI Guarantee are the ones given by the VI Provider in the complete text of the VI Guarantee.

The Excerpt from the VI Guarantee is presented without text alterations, except the ones applied for ease of reading or exclusions from the text of article numbers of the VI Guarantee, given that these Terms and conditions include only an Excerpt of the VI Guarantee and only in informative purposes.

Please note that:

a. The VI Guarantee may only apply in cases when the Flight(s) is/are rescheduled, delayed or cancelled due to factors which can occur in the standard course of air or train or bus transportation. Given this the Guarantee can be applied with limited effect in situations of the impact of force majeure. Furthermore the Guarantee cannot be applied to cases where any changes to the Flight schedule(s) is made without Our previous approval or through Our customer service department.

b. The VI Guarantee is excluded from application:
- If the reservation or any change is made otherwise than through the Company / the VI Provider.
- If any change has been made without prior consent of the Company / the VI Provider.
- In cases of force majeure.
- In case all VI tickets are issued as a single ticket.
- In other cases in accordance with the VI Guarantee provisions.

The application procedure to / of the service named the VI Guarantee is as follows.

If you consider that your situation, within or in connection to one or more flights, is in accordance with the description made in the Excerpt from the VI Guarantee, included in these Terms and conditions, then you should immediately apply to the Company (not later than within the terms provided in the Excerpt from the VI Guarantee + a reasonable term to process and redirect your application to the VI Provider). The Company shall look into your application within a reasonable term and if it sets that, your application might be in accordance with the VI Guarantee provisions the Company shall redirect it within a reasonable term to the VI Provider. If the VI Provider indicates that your application / case is in accordance with the VI Guarantee provisions, the Company shall inform you within a reasonable term letting you know at the same time your respective options.
